Judges to reveal reasons behind immigration decision

Australia's highest court is set to reveal its reasoning behind a landmark ruling prompting the release of detainees from immigration detention.

A majority of High Court judges on November 8 found indefinite immigration detention unlawful, overturning a 20-year precedent and setting in motion the release of more than 140 detainees so far.

The court will on Tuesday afternoon publish the reasons behind its decision, which prompted the federal government to allocate $255 million toward enforcing strict visa conditions.

The High Court of Australia will publish the reasoning behind its decision to find indefinite immigration detention unlawful.

Australian Federal Police will get $88 million for regional response teams and personnel to investigate breaches of such conditions.

The cohort of released detainees has included some convicted criminals.

Although they have already served prison sentences, growing outrage and concerns about a perceived danger to the community prompted the government to rush through emergency laws imposing strict visa conditions.

Of the people released from immigration detention, 132 are being electronically monitored, four are being investigated by the AFP over non-compliance and two cases are being worked through as they involve health issues.

The plaintiff in the High Court case - a Rohingya man from Myanmar known as NZYQ who has since been released - faced the prospect of life in detention as no country would settle him because he raped a 10-year-old child.
